There is no legislated minimum balance. However, ASIC has indicated that an SMSF is generally more cost-effective for individuals with larger superannuation balances. Running costs including accounting, audit, and administration, remain relatively fixed regardless of fund size, so a smaller balance can erode returns. Seek tailored advice before proceeding.
From 1 July 2021, an SMSF can have up to six members. Each member must also act as a trustee (or director of a corporate trustee). Larger funds require careful governance arrangements to ensure all trustees are meeting their obligations.
With individual trustees, each member is personally named as a trustee. With a corporate trustee, a company acts as trustee and members are directors. A corporate trustee structure generally offers greater flexibility, clearer asset separation, and simpler administration when membership changes. It can also make estate planning and succession easier. However, it involves additional setup costs and ongoing ASIC obligations.
Trustees must prepare annual financial statements, arrange an independent audit, lodge an annual SMSF return with the ATO and ensure the fund’s investment strategy remains current. These obligations apply every year, regardless of fund activity.
An SMSF can invest in residential or commercial property, subject to compliance requirements. The property must be acquired and held in line with the fund’s investment strategy and the sole purpose test. Business real property can in some cases be leased to a related party but strict rules apply. Seek specialist advice before proceeding.
A non-complying SMSF can face significant tax penalties. The fund’s assets may be taxed at the highest marginal rate rather than the concessional superannuation tax rate of 15%. The ATO also has the power to wind up a non-complying fund. Proactive compliance management is the most effective way to avoid this outcome.
